Machinery Hire Terms & Conditions

HIRER MAINTENANCE RESPONSIBILITIES

• Daily service – check oils, fuel, lubricants and coolant and grease machinery in accordance with the manufacturer’s specifications. Daily pre-start and log books are to be completed.

• All damage and incidentals are to be reported to WA Mining Industrial Solutions Pty Ltd within 24 hours, regardless of severity.

• For all damage to cab, machinery body and wear on tyres.

• To replace any damaged or worn tyres with the same brand and tread pattern, as per the original supplied by WA Mining Industrial Solutions Pty Ltd.

• To replace any damaged or worn Ground Engaging Tools with the same brand, as per the original supplied by WA Mining Industrial Solutions Pty Ltd.

• Minor repairs – undertake all minor running repairs, including, but not limited to, electrical repairs, tyre repairs, repair or replacement of all air, oil, fuel and water hoses, repair or replacement of u/s lights and warning devices and rectification of minor oil leaks.

• Major repairs – WA Mining Industrial Solutions Pty Ltd will at its own expense rectify any major failure of the machinery. If any major breakdown and damage is due to the following, the Hirer will be responsible for the cost of the repairs:

  • The Hirer failing to service and maintain the machinery to the recommended service intervals.

  • The Hirer failing to complete daily service responsibilities.

  • The Hirer’s misuse of the machinery in adverse conditions.

  • The Hirer’s failure to operate the machinery in accordance with the manufacturer’s specifications.

  • The Hirer’s failure to supply professional operators for the machinery.

  • Oils and lubricants must be checked and filled (if required) prior to returning to WA Mining Industrial Solutions Pty Ltd.

• Machinery will be clean upon leaving WA Mining Industrial Solutions Pty Ltd and must be returned with the machinery, including the cabin, detailed and to have no excess grease, oils or dirt. If the cleaning is not to the satisfaction of WA Mining Industrial Solutions Pty Ltd, professional cleaning will be charged at a rate of $150.00 (ex GST) per hour.

• There is to be no smoking in any machinery supplied by WA Mining Industrial Solutions Pty Ltd.

• All machinery will leave WA Mining Industrial Solutions Pty Ltd with a full tank of fuel and must be returned with a full tank of fuel, otherwise a $3.00 (ex GST) per litre charge will apply.

• Machinery that is returned to WA Mining Industrial Solutions Pty Ltd overdue for servicing will incur a penalty at a rate of $70.00 (ex GST) per overdue hour, unless prior discussions with WA Mining Industrial Solutions Pty Ltd have been undertaken.

• The mobilization and demobilization cost of all machinery and equipment is the Hirer’s responsibility.

CONDITIONS OF HIRE

• All scheduled servicing and maintenance of machinery will be carried out by WA Mining Industrial Solutions Pty Ltd, or an agreed Contractor, and the cost on charged to the Hirer (unless scheduled machinery maintenance has been agreed upon by both parties).

• All machinery remains the property of WA Mining Industrial Solutions Pty Ltd and shall not be rehired or relocated to another area without the permission of WA Mining Industrial Solutions Pty Ltd.

• This Machinery Hire Contract is fixed for the duration of the agreed period of hire. Hire charges to commence from the time the machinery leaves WA Mining Industrial Solutions Pty Ltd premises and continues until the machinery is returned to WA Mining Industrial Solutions Pty Ltd premises as per the terms of the Machinery Hire Contract.

• No allowance will be made to the Hirer for time the machinery is not in use. In the event of machinery breakdowns, hiring charges will not be charged during the time the machinery is not working, UNLESS the condition is due to negligence or misuse on the part of, or attributable to, the Hirer.

• Ensure that all persons operating the machinery are suitably instructed in its safe and proper use and where necessary hold a current Certificate of Competency and/or are fully licensed to operate the machinery and shall provide evidence of the same to WA Mining Industrial Solutions Pty Ltd upon request.

• All personnel operating or driving machinery owned by WA Mining Industrial Solutions Pty Ltd do so at the responsibility of the Hirer and WA Mining Industrial Solutions Pty Ltd are not responsible nor will be held liable for any injury, disability or death to any party.

• A Public Liability Certificate of Currency for a minimum of $20,000,000 must be supplied by the Hirer to WA Mining Industrial Solutions Pty Ltd, together with the signed Machinery Hire Contract.

• All information concerning the hired machinery is to be made accessible to WA Mining Industrial Solutions Pty Ltd on request. This includes, but is not limited to, daily pre-starts, logbooks and maintenance records.

Controlled waste removal

Safe removal and disposal of controlled waste products.

WA Mining Industrial Solutions can safely remove and dispose of controlled waste products including hdryocarbons and fluorocarbons, waste oil and grease.

• Hydrocarbon waste includes liquids, soils and sludges contaminated by oil-based lubricants, petrol and diesel fuels, and polycyclic aromatic hydrocarbons (PAHs).

• Flurocarbon waste including coolants and sealants.

• Removal of waste oil and engine grease.

Our controlled waste removal contractor is fully licensed and equipped to perform the dirty work of safe removal and disposal of waste products.
